Supafield Terms of Service

1. Acceptance of Terms

By accessing or using the Supafield platform, website, and mobile applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to the Business Owner ("Account Holder") and any employees, technicians, or contractors ("Authorized Users") to whom the Account Holder grants access.

2. Account Registration & Security

  • Eligibility: You must be 18 years or older to use the Service.
  • Account Security: You are responsible for maintaining the security of your account and password. Supafield cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  • Responsibility: The Account Holder is responsible for all content posted and activity that occurs under your account (even when content is posted by others who have accounts under your account).

3. Subscription, Billing, and Cancellation

A. Free Trial

We offer a 14-day free trial with no credit card required. You may cancel your account at any time during the trial without penalty.

B. Payments & No Refunds

  • Subscription: Once the trial ends, you must add a valid payment method to continue using Supafield. The Service is billed in advance on a monthly or annual basis.
  • No Refunds: As per our Refund Policy, payments are non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.

C. Cancellation

You can cancel your subscription at any time within the application.

  • Effect: Cancellation stops future auto-renewals. Your access remains active until the end of your current billing period.
  • Data Retention: Upon cancellation, your data is retained in a dormant state to allow for potential reactivation, subject to our Data Retention Policy.

D. Organization Deletion

If you explicitly choose the "Delete Organization" option:

  • Your account is immediately terminated.
  • All data is permanently deleted. This is irreversible.
  • It is your sole responsibility to export your data before selecting this option.

4. Feature-Specific Terms

A. SMS & "Uber-Style" Updates (Fair Use Policy)

Supafield provides SMS capabilities for transactional job updates (e.g., "En Route," "Invoice Sent").

  • Permitted Use: Messages must be related to active jobs or customer service interactions.
  • Prohibited Use: You may NOT use the SMS feature for bulk marketing, spam, or unsolicited advertising.
  • Fair Use: We cover the cost of SMS based on typical usage patterns. If your message volume is disproportionate to your job volume, we reserve the right to throttle service or charge for overage.
  • Consent: You represent and warrant that you have obtained the necessary consent from your end customers to send them SMS messages.

B. "Profit Pulse" & Financial Data

  • Estimates Only: The "Profit Pulse" feature calculates Gross Profit based on user inputs (Labor/Material costs).
  • Not Accounting Advice: Supafield is not a registered public accountant or financial advisor. We do not guarantee the accuracy of these calculations for tax or legal purposes.
  • Liability: You agree that Supafield is not responsible for business losses resulting from decisions made based on Supafield analytics.

C. Offline Sync

While we utilize offline synchronization technology, data sync depends on device health and network availability. We recommend technicians sync their devices via Wi-Fi/Cellular at least once daily to ensure data integrity.

5. User Conduct

You agree not to:

  • Reverse engineer, decompile, or disassemble Supafield.
  • Use the Service to store or transmit malicious code, viruses, or harmful data.
  • Use the Service to harass, abuse, or harm another person (including your customers).
  • Resell, duplicate, or reproduce any portion of the Service without express written permission from us.

6. Intellectual Property

  • Your Data: You claim no intellectual property rights over the material you provide to the Service. Your profile and materials uploaded remain yours. You grant Supafield a license to host and display this content solely to provide the Service.
  • Our IP: The look, feel, and code of the Service (including the "Option Builder" interface design and "Profit Pulse" algorithms) are copyright © Supafield. All rights reserved.

7. Limitation of Liability

To the maximum extent permitted by law, Supafield shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from:

  • The use or the inability to use the Service.
  • Unauthorized access to or alteration of your transmissions or data.
  • Statements or conduct of any third party on the Service.

In no event shall Supafield's total liability to you for all damages exceed the amount of fifty U.S. dollars ($50.00) or the amount you paid Supafield in the past three months, whichever is greater.

8. Governing Law

These Terms shall be governed by the laws of Tunisia, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right to update and change the Terms of Service from time to time. We will notify you of significant changes via email or an in-app notification. Continued use of the Service after any such changes shall constitute your consent to such changes.
